1. APPLICABLE CONDITIONS

1.1 These Terms and Conditions apply to all purchases made in the online store www.vitaran.ee (hereinafter referred to as the “Online Store”).

1.2 The Online Store is owned and operated by Estetix Group OÜ, registration number 11305263, registered address: Kadaka tee 133, Tallinn, 12915, Estonia (hereinafter referred to as “Company”, “Vitaran.ee”, “we”, “us”, “our”).

1.3 We sell products exclusively to aesthetic clinics, licensed doctors, medical professionals with relevant qualifications, and registered legal entities operating in the field. Orders from private individuals are not accepted.

1.4 By registering and placing an order, the Client confirms that they act in the course of professional or business activity and not as a consumer.

1.5 These Terms apply to all website visitors.

1.6 We reserve the right to amend these Terms at any time by publishing updated versions on the Website.

1.7 Orders placed before amendments shall be governed by the Terms valid at the time of order.

2. REGISTRATION & CLIENT VERIFICATION

2.1 Registration is mandatory to access prices and place orders.

2.2 Account activation may require submission of:

  • Valid business registration details
  • VAT number (if applicable)
  • Professional qualification documents

2.3 We reserve the right to approve or reject any registration request.

2.4 The Client is responsible for ensuring all submitted information is accurate and up to date.

2.5 We may suspend or terminate accounts without prior notice if Terms are violated.

3. PRODUCTS

3.1 We distribute original products sourced from authorized manufacturers and official suppliers.

3.2 Product information provided on the Website is for informational purposes only and does not constitute medical advice.

3.3 The Client is solely responsible for proper storage, handling, and professional use of products.

3.4 The Client must follow all manufacturer instructions before using any product.

4. PRICES AND VAT

4.1 All prices are stated in euros (EUR) and exclude VAT and delivery costs unless otherwise specified.

4.2 For Estonian clients, 24% VAT is added at checkout.

4.3 EU-based business clients with a valid VAT number may purchase goods without VAT (intra-community supply), excluding Estonian entities.

4.4 Prices may be changed at any time but will not affect confirmed orders.

5. PAYMENT

5.1 Orders are processed only after full payment has been received.

5.2 Payment methods may include Stripe, Montonio, bank transfer, or other secure providers available at checkout.

5.3 We reserve the right to delay or cancel orders if fraud is suspected.

6. DELIVERY

6.1 Orders can be placed 24/7 and are processed on business days.

6.2 Delivery costs are calculated during checkout.

6.3 We use reliable courier services such as DHL, DPD, or Itella SmartPost.

6.4 The Client is responsible for providing accurate delivery details.

6.5 The Client is responsible for understanding import regulations in the destination country.

6.6 Customs duties, taxes, and import charges are the sole responsibility of the Client.

6.7 Refunds for undelivered shipments will only be processed after goods are returned to us.

7. CLAIMS, DAMAGES & RETURNS

7.1 Claims regarding damaged or missing goods must be submitted within 2 calendar days of receipt to info@vitaran.ee.

7.2 Claims must include photographic evidence and official carrier documentation.

7.3 Confirmed transit damage will result in replacement or refund of product value only.

7.4 Minor packaging damage is not grounds for return.

7.5 Due to hygiene and safety regulations, medical devices and sealed products cannot be returned unless defective.

7.6 Returns from business clients are accepted only in cases of product defects or non-compliance with the contract.

8. RETENTION OF TITLE

8.1 Ownership of goods transfers to the Client only after full payment has been received.

8.2 Until full payment, goods remain the property of Estetix Group OÜ.

9. LIABILITY

9.1 Our liability is limited to the maximum extent permitted by Estonian law.

9.2 We are not liable for indirect damages, including loss of profit, production losses, or reputational damage.

9.3 Our total liability shall not exceed the amount paid for the relevant order.

9.4 We are not liable for misuse of products or failure to follow manufacturer instructions.

10. ADVERSE EVENT REPORTING & RECALLS

10.1 Clients must promptly report any adverse events or side effects to info@vitaran.ee.

10.2 In case of product recall, Clients agree to comply with recall instructions.

11. FORCE MAJEURE

11.1 We are not liable for delays or failures caused by circumstances beyond our reasonable control, including natural disasters, transportation disruptions, governmental restrictions, or other unforeseen events.

12. INTELLECTUAL PROPERTY

12.1 All website content is protected by intellectual property laws.

12.2 Unauthorized reproduction or distribution is prohibited.

13. GOVERNING LAW & JURISDICTION

13.1 These Terms are governed by the laws of the Republic of Estonia.

13.2 Disputes shall first be resolved through negotiation.

13.3 If unresolved, disputes shall be settled in the courts of Estonia.

13.4 We reserve the right to initiate proceedings in the Client’s jurisdiction where permitted by law.

14. SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force.
